By using this website or placing a pickup reservation, you agree to these Terms of Service and our Privacy Policy. If you do not agree, please do not use the site or place a reservation.

You must be 21 or older

This site and all products are intended only for adults of legal drinking age. By using the site you represent that you are at least 21 years old. A valid, government-issued photo ID proving you are 21 or older is required at pickup. We will refuse to hand over an order to anyone who cannot present valid ID, who appears to be under the influence, or where we believe the sale would violate the law — and in those cases the reservation will be cancelled.

Reservations, not online sales

Everything you place through this website is a reservation request to hold products for in-store pickup — it is not a completed purchase and not an online sale. We do not take payment online. No sale is final, and no title to any product passes to you, until you arrive at the store, we verify your age and identity, and you pay at the register. We may decline or cancel a reservation for any lawful reason, including pricing or inventory errors, suspected resale, or unavailability.

Pricing and availability

Prices and availability shown online are estimates based on our most recent records and may be out of date. The price you pay is the in-store price at the time of pickup, including any applicable taxes and deposits. If an item is mispriced or out of stock, we will let you know and you are free to decline. We are not obligated to honor an obvious error.

Pickup, holds, and cancellations

• We hold reserved items for a limited time. If you do not pick up within the hold window, we may release the items back to inventory.
• Because online quantities can lag real stock, occasionally a reserved item is unavailable when you arrive; we will offer an alternative or simply not charge you for it.
• You may cancel a reservation before pickup by contacting us. We may cancel a reservation that cannot be fulfilled or that we believe violates these terms or the law.

In-store pickup only — no shipping or delivery

We do not ship or deliver alcohol. All orders are fulfilled by in-person pickup at our store, by the person who placed the reservation, with valid ID.

Payment and returns

Payment is made in person at the register at pickup. Returns, exchanges, and refunds of alcoholic beverages are restricted by Alabama law and are handled in store, in our discretion and only as permitted by law. Bring your receipt for any in-store question about an order.

Alcohol sales and compliance

Swan Creek Spirits is a licensed alcohol retailer in the State of Alabama. All sales are subject to Alabama Alcoholic Beverage Control law and local regulations. We sell only to individuals who are 21 or older and who present valid ID, and we do not sell to anyone who is, or appears to be, intoxicated. Please drink responsibly.

Text-message terms

If you opt in to order texts, you consent to receive automated transactional messages about your order at the mobile number you provide; consent is not a condition of any purchase. Message frequency varies by order, and message and data rates may apply. Reply STOP to cancel or HELP for help. Carriers are not liable for delayed or undelivered messages.

Acceptable use

You agree to provide accurate information, to use the site only for lawful personal purposes, not to purchase for anyone under 21 or for unlawful resale, and not to interfere with, probe, or disrupt the site or its security.

Intellectual property

The site and its content — including the Swan Creek Spirits name, logo, text, and images — are owned by us or our licensors and are protected by law. You may not copy, reproduce, or use them without our permission, except as needed to browse and place a reservation.

Disclaimers

The site is provided “as is” and “as available,” without warranties of any kind, whether express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the site will be uninterrupted, error-free, or that product information (including price and availability) is complete or current.

Limitation of liability

To the fullest extent permitted by law, Swan Creek Spirits and its owners, staff, and suppliers will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for lost profits or data, arising out of or relating to your use of the site or any reservation. Our total liability for any claim relating to a reservation will not exceed the amount you paid for the items in that order.

Indemnification

You agree to indemnify and hold harmless Swan Creek Spirits and its owners and staff from any claims, losses, or expenses arising out of your misuse of the site, your violation of these terms, or your violation of any law or the rights of others.

Governing law

These terms are governed by the laws of the State of Alabama, without regard to its conflict-of-laws rules. You agree that any dispute relating to these terms or the site will be brought exclusively in the state or federal courts located in Alabama, and you consent to their jurisdiction.

Changes to these terms

We may update these terms from time to time. Changes take effect when posted; we will update the “Last updated” date above. Your continued use of the site after a change means you accept the updated terms.
